EPA Banned the Last Legal Asbestos. Its Own Ledger Prices the Payoff at $6,000 a Year.

In 2024, EPA banned the only form of asbestos still imported into the United States, citing mesothelioma and lung, ovarian and laryngeal cancers. Chrysotile is, in 's own words, "the only known form of asbestos currently imported, processed and distributed in the U.S." Every other form was already restricted. On March 28, 2024, used its authority under the 2016-amended Toxic Substances Control Act to prohibit its remaining uses — chlorine production, industrial gaskets, aftermarket auto brakes — citing mesothelioma and lung, ovarian and laryngeal cancers tied to chronic inhalation exposure. Buried in the same 389-page rule in the Federal Register is 's own cost-benefit ledger for the ban — and the two sides of it don't sit at anything like the same scale.

What switching off asbestos costs

Most of the rule's real economic weight sits in one industry: chlorine production. Eight U.S. chlor-alkali plants still use asbestos diaphragm cells to make chlorine and caustic soda, chemicals that in turn go into everything from PVC pipe to municipal water treatment. The rule requires all eight to convert to non-asbestos membrane-cell technology on a staggered five-to-twelve-year timeline. 's own Economic Analysis puts the capital cost of that conversion, across all eight facilities, at $2.8 billion to $3.4 billion — a bill expects the industry would eventually pay anyway, since chlor-alkali producers were already trending toward membrane cells before the rule existed.

That's the one-time capital bill. The recurring one is smaller but still large enough to trigger a specific federal disclosure requirement: under the Unfunded Mandates Reform Act, must flag any rule likely to cost more than an inflation-adjusted $100 million in a single year. 's analysis says this one qualifies — total annual net compliance costs over the rule's first 12 years range from a $342 million cost in the worst year to a $126 million savings in the best one, depending on how the chlor-alkali conversions land relative to each other. Measured instead as a 35-year annualized figure — the estimated useful lifespan of a chlor-alkali facility — 's range narrows to a cost of $34 million to $43 million a year at a 7% discount rate, or as little as $1 million a year in net savings at 3%. Against a national economy pegs at $27.62 trillion, the agency concludes the rule is "highly unlikely to have any measurable effect."

What says the payoff is worth

Here is where the ledger gets strange. 's Economic Analysis doesn't just estimate cost — it also assigns a dollar value to the cancer cases the rule prevents, the standard cost-benefit exercise TSCA rules require. For the three use categories where had enough exposure-response data to run the calculation — chlor-alkali diaphragms, sheet gaskets in chemical production, and aftermarket auto brakes — the quantified, monetized benefit of avoided cancer incidence comes to $6,000 a year at a 3% discount rate, or $3,000 a year at 7%. Against a worst-year cost of $342 million, that is not a rounding error so much as a different order of magnitude entirely: the quantified benefit is roughly 0.001% to 0.002% of the quantified cost.

does not present this as the whole case for the rule. The same document is explicit that these three categories are the only ones where epidemiological data supported a dollar estimate, and that unquantified benefits — from every other prohibited use, and from cancer risk believes exists but couldn't monetize — are "unquantified benefits" the agency expects to be substantially larger. That caveat is honest. It's also the whole point: a formal cost-benefit ledger that can price the capital cost of eight chemical plants to the nearest hundred million dollars, but can only formally price the value of the cancer deaths it prevents at a few thousand, is a ledger that structurally cannot carry the weight of the decision it's attached to. The $6,000 figure isn't wrong on its own terms. It just isn't answering the question it looks like it's answering.

The toll the ledger doesn't price

Independent of 's rulemaking, 's National Institute for Occupational Safety and Health runs its own surveillance of mesothelioma deaths, built from death-certificate data in the National Vital Statistics System. Its most recent full-population count, published in MMWR, covers 1999 through 2015 — a stretch of 17 years and 45,221 deaths, rising from 2,479 in 1999 to 2,597 in 2015. The age-adjusted death rate fell 21.7% over that period, but the raw count of deaths per year did not meaningfully decline, because a shrinking population of exposed workers was offset by the disease's long latency: notes most mesothelioma deaths trace back to asbestos exposure 20 to 40 years earlier, meaning the 2015 toll mostly reflects exposures from the 1970s and 1980s — years before any of these uses were federally restricted.

's occupational breakdown names who bore that risk: insulation workers carried a proportionate mortality ratio of 26.9 — nearly 27 times the rate expected from their share of the workforce — followed by chemical technicians (4.9) and plumbers and pipefitters (4.8). By industry, ship and boat building (6.7), petroleum refining (4.1), and industrial chemicals (3.8) led. None of those figures move when finalizes a rule; they are the accumulated bill from exposure that already happened, decades before this ban existed.

Still in court

The rule isn't fully settled. Industry groups led by the Texas Chemistry Council petitioned the Fifth Circuit to vacate it, and — per the Asbestos Disease Awareness Organization's account of the court's own scheduling — the court heard oral argument in Texas Chemistry Council v. , No. 24-60193, during the week of June 1, 2026, with a ruling still pending as of this writing. The venue carries its own history: the Fifth Circuit is the same court that vacated 's first, much broader asbestos ban in 1991's Corrosion Proof Fittings v. — the ruling that left chrysotile legal in the U.S. for the following 33 years. Even if the 2024 rule survives intact, its own compliance clock runs long: chlor-alkali facilities have until 12 years after the May 28, 2024 effective date — 2036 — to fully convert, and a narrow exemption for nuclear-waste processing gaskets at 's Savannah River Site runs until the end of 2037.

The takeaway
